Legislation Bill C13

This Bill was brought into effect after a case mostly driven by a supreme court opinion on TTC disability cases.

The supreme court ruled on self insured or administrative services only plans employers must pay CPP and EI contributions (the employee also has to pay CPP and EI while on disability.)

Rather than converting to an insurance plan (which can be about 40 percent more expensive) why not let Organizational Solutions Inc. be your answer in administrating Bill C13. We can provide you with solutions that work.

Our finance team process pay and do the remittances for our clients. So we can easily be your answer in meeting the demands of the new legislation.

Wage Loss Replacement

The treatment of wage loss replacement plans (WLRP) payments for Canada Pension Plan (CPP) purposes changed over the years.

For a period, payments made from certain types of uninsured WLRP plans were not considered pensionable. In December 2011, new CPP legislation clarified that all payments made from uninsured WLRPs are considered to be remuneration from pensionable employment.

This legislation is retroactive to January 1, 2006.

Employers who did not deducted CPP on uninsured WLRP payments in the past, whether those plans follow insurance principles or not, need to start doing so from January 1, 2012.

Employers who deducted CPP on these WLRP will not be refunded those deductions. However, the Canada Revenue Agency will consider any request it receives from employees to review their particular situation on a case-by-case basis.
